Chapter 7 Bankruptcy
Chapter 7 bankruptcy also known as liquidation bankruptcy is a way to get a fresh start while keeping most of your personal belongings. In order to qualify, one must meet the thresholds of a means test. The test takes a look at your income and living expenses against the amount of debt you owe. Most people are able to keep their homes and vehicles in a Chapter 7 while having their unsecured debts discharged. An advantage is that some credit reporting agencies will remove all records of your Chapter 13 bankruptcy filings after 7 years as opposed to 10 years when filing for Chapter 7.
Chapter 11 Bankruptcy
Chapter 11 usually results in a reorganization of the business or personal assets and debts, but can also be used as a means of liquidation.
